These Terms of Use (the "Terms") are a binding contract between you (the "Customer") and Market Push Apps SRL ("MarketPushApps", "we", "us"). They govern your use of the Instagram app for Wix (also shown as "Instagram Feed"; the "App"), which shows the posts of an Instagram account you connect on your Wix site, together with our related websites and support (together, the "Services").
By installing, accessing or using the App, you agree to these Terms and to all applicable laws and regulations. If you do not agree, do not use the App.
The App, its software and its materials are protected by copyright and other intellectual property laws.
1. Eligibility and business use
The App is meant only for users who:
are at least 18 years old, and
act for a business or as self-employed professionals or creators, not as consumers.
By using the App, you confirm that you meet these requirements and that you are authorized to act for the business you represent.
2. Your Instagram account
To show posts, you connect an Instagram professional account (Business or Creator) through Instagram's own sign-in. You may only connect an account that you own or are authorized to manage.
Your use of Instagram remains subject to Instagram's Terms of Use and Meta's policies. You are responsible for complying with them, including for the content you choose to show on your site.
The App reads the connected account's profile and posts only to show them on your Wix site and in the App's dashboard. It never posts, likes, comments or changes anything on Instagram.
You can stop the App's access at any time by removing the App from your Wix site or by removing its access in Instagram's settings. See the Instagram - Data Deletion Instructions.
3. Not affiliated with Instagram or Meta
The App is made by MarketPushApps. It is not made, endorsed or sponsored by Instagram or Meta. Instagram is a trademark of Instagram, LLC.
The App depends on the Instagram API provided by Meta. Meta may change, limit or stop that API, or the access it gives the App, at any time. If that happens, parts of the App may stop working, and we are not responsible for changes made by Meta.
4. License and acceptable use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your business purposes on your Wix site(s).
You must not:
copy, modify, distribute, sell, lease or sublicense the App or any part of it;
try to decompile, disassemble or reverse engineer any software we provide, or otherwise derive its source code;
remove or change any copyright, trademark or other proprietary notices;
use the App to show content you have no right to show, or in a way that breaks the law, Instagram's terms or the rights of others;
try to get around the App's security, or use the App to access accounts or data that aren't yours.
This license ends automatically if you break these Terms. We may suspend or end access to the App at any time if we reasonably believe there is misuse, legal risk or non-payment.
5. Price, subscriptions and refunds
The App is currently free to install and use. We may add paid ("Premium") plans later. If we do, the following applies:
Premium plans are billed through Wix.com Ltd. or its affiliates, which act as merchant of record. Prices, billing periods and included features are those shown on the App's Wix App Market listing or in-app pricing page.
Premium plans renew automatically at the end of each billing period unless you cancel them in your Wix account before the renewal.
All fees are charged in advance and are non-refundable to the maximum extent permitted by law. We do not give partial or full refunds, credits or pro-rata adjustments for cancellation, downgrade or non-use.
6. Data and privacy
How we handle data from Instagram and Wix is described in the Instagram - Privacy Policy.
The App shows your own Instagram posts to the visitors of your Wix site. You are responsible for:
having the right to show that content on your site;
giving your site's visitors any notices that the law requires;
complying with the data protection and privacy laws that apply to your site (including, where applicable, the GDPR).
Where we process personal data about your site's visitors on your behalf, we do so only to provide the App and as described in the Privacy Policy.
7. Disclaimer of warranties
THE APP AND ALL MATERIALS AND INFORMATION PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKET PUSH APPS SRL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. IN PARTICULAR, WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT POSTS WILL ALWAYS BE UP TO DATE, OR THAT THE APP WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR RESULT (INCLUDING FOLLOWERS, SALES, LEADS OR OTHER BUSINESS OUTCOMES).
You use any content or information accessed through the App at your own risk.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKET PUSH APPS SRL, ITS DIRECTORS, EMPLOYEES, CONTRACTORS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKET PUSH APPS SRL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU ACTUALLY PAID FOR THE APP DURING THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, these limitations apply only as far as the law allows.
9. Changes to the App and these Terms
We may change, suspend or discontinue any part of the App (including free features) at any time. We may also update these Terms from time to time.
Where the law requires it, we will give at least 2 weeks' notice of material changes by posting the updated Terms here and/or notifying you through Wix or by email. If you keep using the App after the updated Terms take effect, you accept them.
We are not liable to you or any third party for any change, suspension or discontinuation of the App.
10. Ending your use
You can stop using the App at any time by removing it from your Wix site. Sections 6 to 11 continue to apply after you stop using the App.
11. Governing law and jurisdiction
These Terms are governed by the laws of Romania, without regard to its conflict-of-law rules. You submit to the exclusive jurisdiction of the competent courts in the city where Market Push Apps SRL has its registered office, for any dispute arising out of or relating to these Terms or the App.
