Terms of Use for SMS Blast

Welcome to SMS Blast, a service provided by Market Push Apps SRL! These terms and conditions govern your use of SMS Blast, an SMS sending software as a service (SaaS) available through the Wix App Market, where Wix acts as the merchant of record for billing purposes.
1. Acceptance of Terms
By accessing and using SMS Blast, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, you must not use our services.
2. Service Description
SMS Blast provides a platform designed exclusively for business use to facilitate communication and marketing strategies via SMS. Our service is accessible to businesses that are registered and operate legally.
3. User Responsibilities
- You must use SMS Blast only for lawful business purposes and in compliance with all applicable laws and regulations of both your country and the country of the recipients. This includes ensuring compliance with laws relating to SMS advertising, consent of recipients, and data protection.
- You are responsible for obtaining the necessary consent from customers before sending them SMS messages through our service.
- You are also responsible for being aware of and understanding the legislation regarding SMS communications and potential fines in your country of use and the recipient's country.
- You are responsible for all activities conducted under your account.
- You must ensure the accuracy of the data you input into the service and any information sent through SMS using our platform.
4. Authorization to Obtain Toll-Free Numbers
You hereby authorize Market Push App SRL to apply for and manage toll-free numbers (or their equivalent in other countries) on behalf of your business as needed for your use of SMS Blast. This authorization allows us to act on your behalf in all matters related to the acquisition and management of such numbers.
5. Payment and Billing
Billing for our services is managed by Wix as the merchant of record. You agree to comply with Wix’s billing policies as applicable to purchases made through the Wix App Market. You may cancel the subscription at any time.
The SMS credits available in your subscription will reset to 0 on the 1st day of every month.
6. No Refund Policy
All purchases are final. SMS Blast does not offer refunds for any services purchased through the Wix App Market.
7. Prohibited Uses
You are prohibited from using SMS Blast to send messages related to:
- Politics
- Firearms
- Alcohol
- Tobacco
- Drugs (including THC and CBD)
Additionally, you must not use our service to send unsolicited communications or any messages that are defamatory, offensive, or otherwise in violation of applicable laws or regulations.
8. Limitation of Liability
SMS Blast will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service.
9. Dispute Resolution
Any disputes related to these terms or our services shall be exclusively resolved in the courts of Romania and governed by Romanian law.
10. Modifications to Terms
We reserve the right to modify or replace these terms at any time at our discretion. We will provide notice of these changes by revising the date at the top of these terms and, in some cases, we may provide additional notice (such as adding a statement to our homepage or sending you a notification).
